Cap on pain and suffering awards for minor injuries to be reviewed

The province is reviewing the cap on pain and suffering awards for minor injuries resulting from automobile accidents in response to concerns about fairness.

To help develop and analyze alternatives, a discussion paper was released on Jan. 15, to provide background information about the cap, the types of awards it limits, those it does not, and to summarize known issues with the cap. "The review will assess the need to provide fair compensation while ensuring premiums are affordable," said Finance Minister Graham Steele.

The Office of the Superintendent of Insurance will conduct the review over the next few months. Any legislative or regulatory changes will be introduced in the spring session of the legislature.

The public is invited to read the discussion paper and provide a submission to the Office of the Superintendent of Insurance by Feb. 15.
